SUBJECT MATTER OF THE CASES
The applications concern the allegedly inadequate level of (protected) rent the applicants have been entitled to receive under the domestic law for lease of their flats subject to the protected lease scheme and, in case no. 41306/18, the applicant’s inability to evict the protected lessee and a member of her household and move into her flat subject to that scheme.
QUESTIONS tO THE PARTIES
Applications nos. 48981/17 and 49727/17:
 
Was the level of protected rent the applicants’ have been entitled to receive under the domestic legislation for lease of their flats subject to the protected lease scheme in violation of their right to the peaceful enjoyment of their possessions guaranteed by Article 1 of Protocol No. 1 to the Convention, having regard that they have been unable to recover possession of their flats or rent them out at market conditions (see Statileo v. Croatia, no. 12027/10, 10 July 2014)?
 
Application no. 41306/18:
 
Were the domestic courts’ judgments refusing to order the protected lessee and a member of her household living in the applicant’s flat to vacate it in violation of the applicant’s right to the peaceful enjoyment of her possessions guaranteed by Article 1 of Protocol No. 1 to the Convention, having regard to the level of protected rent the applicant has been entitled to receive under the domestic legislation (see Statileo, cited above, § 143)?
