SUBJECT MATTER OF THE CASES
The applications concern alleged discrimination in the final high school exams of the pupils belonging to national minorities who study at school in their native tongue. The applicants, who are ethnic Hungarians, complain under Article 1 of Protocol No. 12 to the Convention that they have to sit two additional exams (oral and written in their maternal tongue) during the same interval set for the final exams throughout the country. For that reason, they have less time than the Romanian pupils to prepare their exams or simply to rest between tests. They are thus more likely to fail their final exams.
QUESTIONS tO THE PARTIES
1. Have the applicants exhausted the effective domestic remedies as required by Articles 35 § 1 of the Convention as regards their complaint under Article 1 of Protocol No. 12 to Convention?
 
2. Have the applicants suffered discrimination on the ground of their ethnic origin, contrary to Article 1 of Protocol No. 12 to the Convention because of the manner in which the final high school exams are organized (see mutatis mutantis D.H. and Others v. the Czech Republic [GC], no. 57325/00, ECHR 2007‑IV and Zarb Adami v. Malta, no. 17209/02, ECHR 2006‑VIII)?
